I'm confuse about this:
Ordinance (before Independence 1946 - 1957) and Act (after Independence) which can be legislated by Parliament.
Enactment which can be legislated by Dewan Perundangan Negeri.
Those above are written law.
Laws that can be legislated known as statute.
So, are they statute?

One of my friends in Canada wrote this for me:
ReplyDeleteEnactment is and Act would also be.n It is also law and can be a treaty. I think an ordinance is a lesser form and would not be a part of statute. Statutes are legislated normally and ordinance are not.
Ordinance
An executive decision of a government which has not been subjected to a legislative assembly (contrary to a statute). It is often detailed and not, as would be a statute, of general wording or application.
Its a bit different with Malaysian Law I guess as our act is known as ordinance before Independence. If act is statute, why not ordinance?
ReplyDeleteEnactment is known as ordinance too in Sarawak.
*fainted*
An enactment is a statute, however in the name it is call an "Act"
ReplyDeleteordinance means an authoritative rule or a statute enacted by a city government
so ... I guess they are basically the same.
